Employment Rights Bill: roadmap

 

Below is a link to the current phased rollout roadmap for the Employment Rights Bill, setting out when key measures are due to take effect.

 

Whilst we know the expected dates for when these measures will take effect, much of the detail is still to be determined. Prior to these implementation dates, the Government is undertaking a series of consultations to inform the detail and delivery of the Bill. These consultations are scheduled as follows:

  • Reinstatement of the School Support Staff Negotiating Body (SSSNB)
  • Fair Pay Agreement for the Adult Social Care sector
  • Introducing ‘day one’ protection from unfair dismissal, including the statutory probation period process
  • Trade union measures, including:
  • Electronic and workplace balloting
  • Simplified recognition processes
  • Duty to inform workers of union rights and right of access
  • New rights and protections for trade union representatives (to be addressed through an ACAS Code of Practice consultation)
  • Ending “fire and rehire” practices
  • Regulation of umbrella companies
  • Introduction of bereavement leave
  • Enhanced rights for pregnant workers
  • Ending exploitative use of zero hours contracts

 

  • Further trade union protections (including protection against detriment for taking industrial action and blacklisting)
  • Tightening tipping law
  • Changes to collective redundancy procedures
  • Flexible working arrangements
  • Insights from these consultations will help shape the final policy positions, which may be implemented through regulations, guidance, or updated Codes of Practice. In some cases, there may be multiple rounds of consultation, particularly where Codes of Practice are being developed or updated. The timing of when new measures come into effect will be informed by the outcomes of these consultations.
